Ask a Lawyer with Mike Dyer.

Steve Sleeper here and I’m with workers comp lawyer Omaha Lincoln Nebraska Mike Dyer. Mike, we’re talking about workers comp. What should I do if I get hurt at work?

[Mike] Well, if you get hurt at work, it’s your obligation to report it to your employer right away. You have to let them you’ve been hurt. And reporting doesn’t mean filling out a form. It means letting your supervisor know you’ve got an injury. The biggest problem is people get hurt at work and they don’t think it’s a big deal. Your opponent, the workers compensation insurance adjuster, is going to say you didn’t report it right away and say you made it up later. So, it’s in your best interest to report right way.

Also, if you’re hurt at work, go see your own doctor. Some insurance companies give a form that says you will see their doctor. Don’t agree to that. You get to see your own doctor, and your doctor is going to know you and trust you. Your doctor has treated you and maintained a medical record.

The insurance company doctors are hired by the insurance companies and they market themselves as being able to save the insurance company money. The only money the insurance company is going to save is what they would have spent helping you get better.

Ask a Lawyer with Mike Dyer.

Hi, Steve Sleeper here with Worker’s Compensation Lawyer Omaha and Lincoln Nebraska Mike Dyer. Mike, an obvious question; what is workers compensation?

[Mike] Workers compensation is a set of statutes and laws. Chapter forty eight of the Nebraska law specifically spells out the rights of an injured employee. And because they’re in the statute, those rules should be looked at like every other statute.

Workers compensation is figured over time. If you work forty hours a week and you’re working at x dollars an hour, you should be paid for those forty hours. If you’re work fifty hours you should be paid fifty hours at X dollars. Between 40 and 50 hours, you should get time and a half.

Everybody understands that’s the law. The law for worker’s compensation is written accordingly and it gives you the same rights.

With worker’s comp, you’re allowed to see your own doctor. You’re allowed to pick your own surgeon if you need to have surgery. You get paid and compensated for mileage. You have all your treatment paid for. If you’re left with a permanent impairment or permanent restriction; depending on your injury, there’s compensation for that.

There’s no pain and suffering allowance in worker’s compensation. It’s statutory. The law says, this part of your body, if you’re hurt, gets this much and there’s formulas they work with. So if you hurt your arm or your hand, you get so many weeks of benefits. If you hurt above your elbow – you’d get 225 weeks of benefits for your shoulder.

What does that mean? Take how much you were making a week before, calculate that out. Two thirds would be an average over twenty six weeks. Then they take that fraction and pay you for those weeks.

If you have an injury to your spine, your neck or your back; the impairment your doctor gives you is not nearly as important as the loss of earning evaluation. If you have a neck or a back injury, workers’ comp looks at that completely different than if you had a knee or elbow injury.

And they ask, “What’s your loss of earning ability?” They will factor in your age, your education, your skills, your training and your experiences. They’ll take a look at a functional capacity evaluation that’s usually a multi-hour test and see how much lifting, pulling, stretching, stepping and carrying you can do. It will put you in a certain work category and a vocational rehabilitation counselor will take all that information and come up with a loss of earning percentage. If you can’t go back to doing the kind of work you were doing; the vocation rehabilitation counselor can help you find another job. If that doesn’t work, they’ll get you some education.

Ask a lawyer with Mike Dyer

Hi, Steve Sleeper here. I’m with motorcycle personal injury lawyer Omaha Mike Dyer. Mike, I know there’s a certain thrill and freedom, and I haven’t met too many bikers that aren’t safe about what they’re doing. But being on a motorcycle; it’s different than being in a car. With a motorcycle accident, there are things one needs to be thinking about to make sure they are taken care of, right?

[Mike] Sure. If you’re on a motorcycle, most people are not seeing you. Drivers need to look twice look for motorcycles.

I’m thinking of a nice couple I went to see because they were in body casts. A car pulled out in front of them at 30 miles an hour and they went from 30 to 0 and had very severe injuries. The kind of injuries you’re going to get on a motorcycle; they’re usually not minimal. Either you’re not hurt or you’re hurt severely.

The one thing motorcyclists don’t appreciate is how much insurance they need to have because the person who hits them may not have enough insurance or no insurance. They can be stuck with all the bills. Let’s say the car driver has minimal $25,000 coverage, and your motorcycle coverage is only $25,000 or $50,000. If you have a body cast, and you’ve had 6 surgeries to put screws in, to put your body back together, that bill is $80,000. You don’t have enough money to pay your medical bills, never mind all the time you’re going to have lost from work, all the pain you’ve endured, all the permanent impairments and restrictions you’re going to have.

Personal Injury Lawyer Ralston

Personal Injury Lawyer Ralston Personal Injury Lawyer Ralston

Personal Injury Lawyer Ralston Personal Injury Lawyer Ralston

Ask a Lawyer, with Mike Dyer. Hi, I’m Steve Sleeper. I’m here with personal injury lawyer Ralston Mike Dyer. Mike you and I have been talking for a while. One of the things that you brought up is the insurance company is not going to be on your side when you’re in an accident, right?

[Mike] You really do need a personal injury lawyer to look out for your best interests. The insurance company’s in business to make money and, they’re technically, your opponent. Their job is to save the insurance company money, and to keep profits with the shareholders.

[Steve] You told me a story where someone called the insurance company and the insurance agent said she had nothing to worry about.

[Mike] She was hit by a truck and the agent said the trucker was at fault, so they should pay for everything. She went a week without having her car fixed; and with no hope of having her car fixed, because the other person had not even looked at it yet.

She had this provision in her car insurance, called uninsured or called collision insurance. The collision insurance pays for your car, whether you’re at fault or not. You bought this policy, and you should have your car repaired, without having to worry about some other headache. You paid for the coverage. After a couple of days, if you don’t have your car fixed, you should use your own car insurance, and have your collision insurance pay for it. The agent tried to insist on not using that insurance.

[Steve] So the key is to have the consumer’s best interests taken care of. An injury lawyer really is in their best interest.

[Mike] Well, they’ll at least help you exercise your rights. If people just treated people the way they were supposed to be treated, I probably wouldn’t have a job. With insurance agents, even though they sold you the policy and collected a premium and got a profit and income; if there’s a claim – they loose some of that profit at the end of the year. So, rather than loosing a few dollars of income, they’d rather have you inconvenienced for a week or two, because it’s their bottom line as opposed to yours.

[Steve] How does an injury lawyer get paid? Is it contingency?

[Mike] I don’t get paid on the property part. That’s just something that we help facilitate and speed things along. If there’s an injury involved – that would be an occasion wherein somebody else is at fault and you decide you want to hire an attorney – yes I would be paid at the end on a contingency.

But, it’s my practice I don’t take a fee from any of the collision work or any of the repair work. I just try to facilitate it so the person’s not sitting there for an extra week or ten days without a car.

[Steve] So it’s really about serving the best interest of the consumer.

[Mike] Yep, pretty much.

Cop Personal Injury Attorney Omaha

Cop Personal Injury Attorney Omaha Cop Personal Injury Attorney Omaha

Cop Personal Injury Attorney Omaha Cop Personal Injury Attorney Omaha

Hi, I’m Steve Sleeper, I’m here with cop personal injury attorney Omaha, Mike Dyer. Mike, a police officer getting injured on the job is different than if I get in a car wreck First of all that’s got to be one of the most dangerous jobs around. But also, they’re there to serve the public. Talk about what the average cop is going to be up against getting injured on the job.

[Mike]. Well I’m a retired New York City police officer. I retired in 1985 on a line-of-duty injury and I came in Nebraska in 1987. Cops are first responders. They are the ones who go to help others. When you need help, they’re going to come. They’re the first to volunteer to run through that door. When a building’s on fire and everybody is running out, the cops are running in.

You are who other people rely on for help. So it’s very humbling to ask somebody else for help. You’re bulletproof. You’re the person who doesn’t have this need for anything because you’re the provider.

Cops don’t realize being hurt in line of duty is not part of the job. I’ve had more cops come in who thought, “I had my shoulder jacked up and I had a surgery on my shoulder. I was wrestling with some bad guy and the department paid for the surgery, and that’s it.” Then I ask if they got the impairment rating for their shoulder. Their response is, “What impairment rating? What are you talking about?”

Cops don’t know they’re entitled to that benefit. Maybe they’ve heard something about some money they can get. But they think it’s kind of like being on the football team. We suck it up. We work hurt. And that’s not true. You’re paid a salary to be a cop. You’re not paid a salary to leave your elbow, your knee, your shoulder, or anything else on the field.

And if you’re hurt, especially by somebody whose negligent, not only are you entitled to the worker’s comp benefits, but you’re also entitled to be compensated for the general damages worker’s comp doesn’t pay you. Just because a cop is sworn in, it doesn’t mean they’re surrendering any rights they have as Nebraska citizens.

If a drunk driver runs into your cruiser, you have the same rights as a family that’s coming back from services on the weekend and gets blasted by a drunk driver. You don’t surrender those rights. We’re not looking for a nickel more, but a cop should not be paid a nickel less for what they’ve been enduring.

[Steve] So being the first responder doesn’t mean you’re there to get hurt. It means you’re the first responder.

[Mike] Right, your job is to go there and help people the best you can. If you get hurt your job title is not to surrender the use of your legs or your feet or anything else. If you’re hurt trying to make an arrest or something like that; you’re supposed to be compensated if you’re left with a permanent impairment. For the rest of your life you’re going to have to live with this restriction.

If you’re in somebody’s home and it’s a domestic squabble and one of the spouses decides they’re gonna beat the cop up; the guy who breaks the cop’s nose is liable to that cop. Just like anybody else who breaks your nose. They don’t get a freebie just because you’re a cop.

If a drunk runs into you, not only do you get all the workers comp paid for by your department, you’re also entitled to everything else every other citizen is entitled to. I’ve represented many cops who were sitting by the side of the road running radar and were blasted from behind. You’re apprehensive sitting there the rest of your life. That’s part of the damages that you’ve endured.

[Steve] Thanks Mike. [Steve } Thanks Mike. Worker’s Compensation Lawyer Omaha Lincoln Nebraska

via Tumblr bit.ly/18Jzizh Worker’s Compensation Lawyer Omaha Lincoln Nebraska via Tumblr bit.ly/160ucMY Worker’s Compensation Lawyer Omaha Lincoln Nebraska Worker’s Compensation Lawyer Omaha Lincoln Nebraska Worker’s Compensation Lawyer Omaha Lincoln Nebraska Ask a Lawyer with Mike Dyer. Thanks Mike. Personal Injury Lawyer Ralston

via Tumblr bit.ly/18JzgaQ Personal Injury Lawyer Ralston via Tumblr bit.ly/160ubZq Personal Injury Lawyer Ralston Personal Injury Lawyer Ralston Personal Injury Lawyer Ralston Ask a Lawyer, with Mike Dyer. [Steve] Thanks Mike. What are you talking about?” Cops don’t know they’re entitled to that benefit. [Steve] Thanks Mike. [Steve } Thanks Mike. via Tumblr bit.ly/18NsfJs Worker’s Compensation Lawyer Omaha Lincoln Nebraska Ask a Lawyer with Mike Dyer. Thanks Mike.
